SUPREME COURT—IN BANCO.
Wednesday, August 13. (Before their Honors the Chief Justice and Mr. Justice Richmond.) -LAND TRANSFER ACT EX PARTE BANK OP AUSTRALASIA. Mr. Travers moved for a rule nisi calling on the district land registrar at Napier, and the caveator, to show cause why the caveat should not be removed, and the land brought under the Act. The motion was heard, and ultimately withdrawn. AEIHI TE NAHU V. BUSSELL. In this case, which was a motion for a decree, Mr. Travers appeared for the plaintiff, and Mr. Chapman for the defendant. It being found that there was a defect in the plea, leave was given to amend the plea within three weeks. CAPSTIOK V. POHAKI. This was a motion to dismiss for want of prosecution, Mr. Hutchison appearing for defendant. An order was made that plaintiff should deliver the declarations within twentyone days, otherwise the action would be dismissed with costs, subject to filing affidavits of service. BE WILL OP JAS. MITCHELL. This case was brought under the notice of their Honors by Mr. Gordon Allan, and after some discussion, was adjourned to Chambers.
