(Before his Honor the Chief Justice and a Special Jury.) The Court re-opened at 10 a.ra. BISHOP V. MACDONALD.
Eot the plaintiff—Mr. F. M. Ollivier. For the defendant—Mr. Travers, with him Mr. Edwards.
In this case, Mr. Robert Cooper is plaintiff, and Mr. Thomas - Kennedy Macdonald defendant.
After an hour and a half’s delay on the question as to whether Mr. Capper should be allowed to serve on the jury (which will be found reported in another column),
Mr. Ollivier stated that this was an action brought by the plaintiff, Robert Bishop, against the defendant, Thomas Kennedy Macdonald, to recover damages by reason of the seizure by the defendant, about the 28th October last, of certain goods and chattels which belonged to the plaintiff. The amount sought to be recovered was £350. The defendant pleaded a general i«sue. On the application of Mr. Travel's, the witnesses on both sides were ordered out of Court.
An application was made to add certain pleas, and as it was considered that these might be of an elaborate character, and possibly the subject of demurrer, it was agreed between the counsel on both sides to postpone the trial until the next sittings of the Court. The Court then adjourned till ten o’clock next morning.
