The short title of this Act- -shad ba the Iviul.va.vs Conatr iction ict. 1878. ~ 4 , tI This Act shall be deemed to be a special Act. authorising the construe ion or excel alnn of all or any of the railways mentioned in the schedule here'o, and any railway constructed under this Act shall bo so constructed under and subject to the provisions of Parts i„ 11., 111.. IV., and VI. of the Public W-. rks Act, IS7O, which said parts, together with the provisions of any Act amending ‘he same, a e hereby incorporated. . . The Governor mav from time to time, in the name and on behalf of her Majesty, contract or enter into arrangements with any person for ihe construction, extension, or maintenance of all or any of the railways mentioned in the said schedule and for that purpose may do or cause to be done any of the following things(l.) Cause sue i mq tries, reports, and surveys to be ma le. and such acts and proceedings to be done and taken as may be n to determ ne tho O’jst Hue mid direction of such r ulway. (2.) Take, purchase, or agree to purchase any land or requisite for the construction or extension of my such railway. (3 ) Contract that any o: the said railways almll bo constructed and maintained, or extended and maintained, upon the terms that no moneys shall be paid or payable in respect hereof until the whole of the works connected ther with have been fully com piete-t in accord mce with such contract. The Governor may purchase, or agree to purchase or acquire, from the native owners, any lauds deemed necessary for the construction or extension of any railway mentioned in the said schedule; and every such purchase or acquisition, or agreement to purchase or acquire any such lands, shill be deemed to be a purchase or acqmsiti >n within the moaning of the Government Native Land Purchases Act 1377. , # ... For the purpose of paying for the construct on, extension or maintenance of any of the lines of railway mentioned i-j the schedule hereto, or for the purchtse or acquisition of any land require 1 for the sama.there may from time to time be issued and applied out of the Public Works Fim I any sum or sums of m may nut exceeding the sum mentioned in the schedule and set opposite the name of each lino of railway The const.ru tion of *he branch line of railway moutimei in the said schedule as “Main line to Sh iv Point" shall i>e contingent upon the cost thereof being d frayed by the Shag Point Coal Company. Limited ; and such bnnch lino, when constructed, shall be managed and worked upon such terms and conditions as shall bo 'greed upon by the Minister for Public Works and the said company. Out of any Cro-vn I mils withdiawn from sale under the provision! of the Laud Act, 1877, the Gove nor ra-y from time to time set apart lands of special value for sale or disposal under the provisions of the said Act; bub no such sa «or disposal shall take place until af*er two months’ notice there f has been gazetted.
