To JAMES DAY, Master of the brig Star of Baltimore, in the United States of America, now lying in the port of Lyttelton, in the Colony of New Zealand ; WALTER TURNBULL, of the City of Wellington, in New Zealand, merchant, trading under the firm or style of “W. and G. Turnbull and Company and to CHARLES EFFINGHAM CAPPER, of the City of Wellington, aforesaid, clerk. Whereas an action was on the seventeenth day of October, one thousand eight hundred and seventy-eight, commenced in cur Supremo Court of New Zealand, at the suit of Josbwi Edward Nathan, of the City of Wellington, merchant, trading under the name and style of “Joseph Nathan and Company,” against Heinrich Heli.mf.r3, of Baltimore, aforesaid, shipowner, who is not within the said colony wherein the said plaintiff claims to recover from the defendant the sum of two hundred and eighteen pounds eighteen shillings and eightpence : And whereas a copy of the writ in the said action, and of the declaration annexed thereto, together with an affidavit verifying the matters contained in the said declaration, and showing that the cause of action arose in respect of the breach of a contract to be partly performed in the said colony, aud that the defendant is not within the said colony, have been filed in our said Court : Aud whereas we are informed thot you, the said James Day, and you, the said Walter, Turnbull,' and Charles Effingham Capper, respectively, or some or one of you, now have j respectively in your charge or under your conI trol certain property and moneys belonging to the defendant, being the said brig Star, with I the boats, tacke, furniture, and apparel of the same, aud moneys received and receivable by you or some or one of you tor freight on goods carried in the said ship. Now, we hereby command you and each of you that, after the service of this writ upon yon, and until the same shall be dissolved, you do not knowingly dispose of or part with any part of the said property or moneys excepting only to the 1 use of the plaintiff in this action. .
