RAILWAYS CONSTRUCTION BILL.
A Bill intituled “An Act to provide for the Construction anil Extension of Railways.” Bo it enated by the General Assembly of New Zealand In Parliament assembled, and by the authority of the same, as fallows: — The short title of this Aot shall be " The Railways Construction Act, 1373.” This Act shall bo deemed to bo a special Act, authorising the construction or extension of all or any of tho railways mentioned in the schedu o hereto, and any railway constructed under this Act shall be so constructed under and subject to tho provisions of Parts 1., 11., 111., IV., and Vf. of the Public Works Act, 1870, which said parts, together with tho provisions of any Act amending the same, are hereby incorporated with this Act. The Governor may from time to time, in the name and on behalf of her Majesty, contract or enter into arrangements with any person for the construction, extension, or maintenance of all or any of the railways mentioned in the said schedule, and for that purpose may do or cause to be done any of tho follow ; I ng tilings : —(1.) Cause such inquiries, reports, and surveys to be made, and such acts a d proceedings to be done and taken as may be necessary to determine the best line and direction of such railway- (2.) Take, purchase, or agree to purchase any land necessary or requi-ite for the construction or extension of any such railway. (3.) Contract that any of the said railways shall be constructed and maintained, or extended and maintained, upon the terms that no moneys shall be paid Of payable in respect thereof until the whole nf the works connected therewith have been fully completed in accordance with such contract. The Governor may purchase, or agree to purchase or acquire, from the native owners, any lands deemed ncce-sary for the construction or extension of any railway raent oned in -he said schedule ; and every such purchase or acquisition, or agreement to purchase or acquire any such lauds, shall be deemed to be » purchase or acquisi'iou within the meaning of tho Government Native Land Purchases Act, 1377. For tho purpose of paying for the construction, extension, or maintenance of any of the lines of railway mentioned in the schedule hereto, or for the purchase or acquisition qf any land required for the same, there may from lime to time be issued and applied out of tha Public Works Fund any sum or sums of money not exceeding the sum mentioned in the schedule and a*t opposite tho name of each line of railway. The construction of the branch lin» of railway mentioned in the said schedule as “Main line to Shag Point” shall be contingent upon the cost thereof being defrayed by tho Shag Point Coal Company, Limited: and such branch line, when constructed, shall bo managed and worked upon such terms and conditions as shall e agreed upon by the Minister for Public Works and tbo said company. out of any Crown lands withdrawn from sale under the provisions of tho Land Act, 1877. the Governor may from time to time set apart Jands of special value for or disposal under the provisions of t'ie said Act: but no such sale or disposal shall take place until after two months’ notice thereof has b.on gazetted.
