Wednesday, August 28. (Before his Honor Mr. Justice Richmond). DUCKERIDGB V. WARDELL. Judgment was delivered in this case, discharging with cunts a rule, for a now trial obtained by Mr. Izard. Leave to appeal was given on the usual terms. ARROW V. HARDING. In this case a vor Uct had been given fer the plaintiff upon an action forlibo! tried before Mr. Justice Richmond at the last circuit sittings at Napier. The libel complained of was a letter written by the defendant'to the Wuipawa County Connell, complaining that Mr. arrow, the Returning Ollicor, had improperly divulged how ho (defendant) had voted at a recent election of a member for that Council. Mr. Bell moved for an injunction <o restrain the defendant, a sawmillev, from cutting timber on a block of land in Hawke’s Bay. claimed by the plaintiff anil others as owners according to native custom. Mr, Chapman was against the injunction. The Court reserved judgment. JONE 3 V. A3HTON. < ’ Dr. Duller moved for a rule absolute for a prohibition against tho District Judge for tho Westland District, to restrain him from proceeding fu thor in the above action, on the ground tint the District Court had no jurisdiction in the matter, a question of title .to hand being involved in the decision.
