SUPREME COURT—CIVIL SITTINGS.
Thursday, July 25. (Before his Hoaor Mr. Justice Richmond and a special jury.) JOHN MCDONALD V. JAMES GUILDFORD. The following jurors were sworn :—Arthur Warburton, John Watt, Henry Wilcox, E. Zohrab, J. IT. B. Wright, Robert Bruce Wallace, E. W. Xowe, Isaac Pliramer, Andrew Reid, Samuel Palmer, G. S. Sellar, and L. P. Blundell.
Mr. Bell for the plaintiff, Mr. Gordon Allan, with him Mr. Brandon, jun., for the defendant.
The plaintiff was a saddler who had carried on business in Larabton-quay, and the defendant was a tanner and leather merchant. The plaintiff sought to recover the sum of £3OOO as damages for the wrongful seizure and sale of his stock and other goods, alleged to have been made under the provisions of a bill of sale. It was said that a demand in writing of the amount duo by the plaintiff to ;the defendant had not been duly made, as provided by the bill of sale, which was dated 22nd July, and the seizure was'made on tho 26th October, 1877. The amount secured by the bill of sale was £IOOO and further advances. It was alleged that the £IOOO was merely put in as' a round number, and so much was not due. At a later day an account was rendered to the plaintiff, stating that.on the 26th July—the date of the bill of ga le—the sura duo to the defendant was £1460. The defendant contended that a proper demand had been made, and that the goods seized were sold at a fair price. A very great deal of evidence respecting accounts between the parties, and the usages of the saddlery trade, was given, and at a 6 the case was adjourned until the next day.
