Tuesday. May 14. (Before J. 0. Crawford, Esq., R.M.) DRUNKENNESS. Charles Payne, who had been remanded from Saturday, for drunkenness, was discharged. BREACH OP CITY BY-LAWS. Archibald McPherson was charged with allowing three pigs to stray at large at Johnson ville. Defendant made a long statement to the Bench, in which he tried to lay a share of blame on the complainant. His Worship remarked that his defence was a most ingenious one, but he considered the charge proved, and fined him 10s. and costs. CIVIL CASES. Kirkcaldie and Co. v. Stewart.—Claim, £29 17s. 9d., goods supplied. Judgment was given for £7 19s. 9d, . Same v. Thomas TJrwio.—Claim, £5 93. 7d., goods supplied. Judgment for plaintiff for the amount claimed and costs. W. and G. Haybittle v. Ebner and Co.— Claim, £22 ss. lOd. Judgment for plaintiff for the amount claimed and cos^s. McDowell v. Donnelly.—Claim, £9 17s, Judgment for the amount claimed and costs. J. Gleland v. J. P. Vause.—Claim. £34, for balance of rent. The case was called on last week, and as the defendant did not appear, judgment was given for the plaintiff. Mr, Wilson, who had been retained by Mr. Vause, shortly afterwards came into Court and asked for a re hearing of the case, which was granted. From the evidence yesterday, it appeared that Mr. Vause had rented a house from the plaintiff, on a twelve months* agreement, - at £9O per annum. Before that time had expired, Vause left the place, and plaintiff had to relet the house at a reduced rental. For the defence it was contended that the house was in such bad repair that it was utterly uninhabitable ; that the plaintiff ha I been spoken to on the subject, and had promised to put the house in repair, but had neglected to do so. His Worship gave judgment for £23 19s. 6d.
