The Union. Co.'a s.a, Tanpo, witu cargo and pasaongerj, from Auckland via Bast Coast ports, arrived at the wharf at 7.30 a. m. yesterday. She left Auckland at 4.30 p.m, 1 on Thursday last, and reached Tanning* at 7.30 a.ra. next day; delayed therj till 11 a.m., and Iheu pushed ahead for Poverty Bay, making Gisborne at 7 o'clock on Saturday morning; left same afternoon at 3.30 o'clock, and got into Napier at 7 a.m. on Sunday. Stayed there 5 hours landing and shipping passengers, cargo, and mails, and then headed for 'Wellington, arriving as above stated. Experienced fine weather till noon on Sunday last, when the wind chopped into the southward and blew a hard gale from that quarter, lasting till 4 a.ra yesterday, when It went into the N.'W’., and continued so until arrival here. ASSAULT ON T_fIEIHIGH SEAS. (From tho Melboorno Leader, April 13.) Carl Sager, captain oJC the barque Cardiganshire, was charged on the sth instant, on remand, at the Williarostown Police Court, with having feloniously assaulted one Adolph Witt, able seaman, on the high seas, while on a voyage from the Mauritius to this port. Adolph Witt had. by (be captain’s orders, been confined in the lazaretto, for, as it is alleged, refusing to obey orders. Alfred McDonald, the chief mate, and John Nelson, the boatswain, upon the nap- : tain's authority, placed a chain round Witt’s waist, thereby fastening hint to a stanchion in the iaznrette. Witt's hands were, also handcuffed, and be states that unnecessary violence and cruelty were used towards him while be was being fastened down. The chain was an inch and a half topsail sheet chain. Witt alleges that his health suffered in consequence, and tlmt rats were so numerous in the lazaretto that they gnawed away at tho tips of his fingers. He remained chained in the lazaretto from the 10th February nntll the 13th March, when the vessel arrived in port. It Is urged in defence that Witt was an extremely violent and intractable seaman. Also, that the captain removed the irons from Witt’s legs to his waist for humane purposes, and that the lazarette was the only place in the ship where a prisoner could be kept, and that it was not a very uncomfortable j compartment. Witt, upon his arrival here, instituted ■ civil proceedings against Captain Carl Sager, laying damages at £IOOO. He was subsequentlyinduced to' abandon a civil action upon receiving fifteen guineas and his lull wages. Sub-Inspector Lamer, however, instituted a criminal prosecution against Carl Sager, and the case was heard at the Williamstown Police Court on 2Ctb March. The case was subsequently dl«mlssed on a technical objection founded upon an Jrregularity> in the procedure of prosecution, there having been no Information sworn. On the 3rd inst., Adolph Witt swore the necessary information, and the captain was arrested and brought before the City Court, from which place he was remanded to Willlamstown. He was represented by Mr. D. Harooart, while Mr. J. G. Unity appeared to prosecute. Mr. Harcourt took a preliminary objection that the Court liad no Jurisdiction, having already heard and determined the same information, and that It hail no pimer to go behind Us former (UimiMal. The Bench overruled the objection, and evidence was taken.
