RESIDENT MAGISTRATE’S COURT.

Thursday, April 18. (Before J. 0. Crawford, Esq., E.M.) drunkenness. , Andrew Evans for this offence was fined 55., or the usual alternative of twenty-four hours’ ‘imprisonment, AK UNREGISTERED DCO. Andrew Geerie was summoned, on remand, for having in his possession an unregistered dog. At a former hearing of the case an adjournment was granted to the defendant in order that he might prove that the dog was under six months’ old, Defendant called W. Archibald, who fully proved to the satisfaction of the Bench that the dog was not six months old. The case was accordingly dismissed.

FORGERY. - i Owen Cameron, on remand, was charged with obtaining goods from George Pirie, draper, by means of a valueless cheque. Accused pleaded not guilty. The first witness called was William Weymss,whodeposed that he was a draper's assistant in the employment of George Pine. The prisoner came to the shop on Saturday, the 13th Instant, and asked to be shown some ladies’ dresses. After being shown several: articles, prisoner purchased goods to the amount of £4 13s. 6d., and tendered a cheque for £lO, signed by J. andD, Sinclair, on the Bank of Australasia. Prisoner stated to witness that he had been working,for Messrs. J. and D. Sinclair, at Wainuiomata sawmills, and'that the cheque was .for. wages. Witness then gave prisoner back as change £5 6s. 6d. The cheque was subsequently paid with other moneys into the Bank of New Zealand. G. H. Norman, teller at: the Bank of New Zealand, deposed that the cheque in _ question . was paid into their bank on the 13th lost., and returned “no account.” ■ Messrs. Sinclair, of Wainuiomata, had no account at the Bank of .New Zealand. Duncan Sinclair, of the firm of J. and D. Sinclair, deposed .that prisoner was in his employ for six weeks, and left threeweeks ago., ! Tho: cheque produced was not ..signed by'witness. _ - j The prisoner was then charged ,with obtaining from Messrs. Wilson and Kichardson-goods and money, to the amount of £lO by means of a valueless cheque. Prisoner again pleaded not guilty. H. E. Davies, an assistant in the shop of Messrs. Wilson and Eichardson, deposed that prisoner came to their shop on 11th inst., and bought goods to the amount of £3 195., for which he' tendered a cheque on the Bank of New Zealand for £lO, signed by J, and D, Sinclair. ! - Witness gave prisoner back as change £6 Is. . i! J, W. Eichardson deposed that he paid the cheque produced into the National Bank.; It was returned “no account.” He was, subsequently told the. cheque was a forgery. F, J. Hoxley, ledger-keeper in: the Bank of New Zealand, deposed that the cheque was presented at the bank last week. The amount was not paid; as Messrs. J. and D. Sinclairjhad no account - at the hank. Afterthe ■ usual caution had been .read, prisoner atated that he might have been guilty of the charge, but that he knew nothing whatever about it, a« he:had been on the spree. If, however, he had signed the cheques, it was not done with a felonious insect, The • prisoner was then committed to take his trial at the Supreme Court on both charges. . , -

Mr. Fitzgerald appeared for the plaintiff, and Mr. Ollivier for defen* dant, After hearing , the evidence his Worship gave judgment for plaintiff, with costs. -Brown’, v. Davidson,—Claim £26 ; 10s., balance of account. Mr. Quick appeared for the plaintiff, and Mr. Allan for the defendant., From the evidence it appeared that the par-, ties concerned were farmers residing at (the Hutt. - In the month of August last plaintiff Bold to the defendant a stack of straw for £35. After the bargain was settled defendant carted away several tons of the straw, for which he ' paid £3 10s. . The remaining portion ho refused to take, assorting th# it was had.
