COURT OF APPEAL.

Monday, January 28. (Before his Honor Chief Justice Preudergast and Mr. Justice Richmond.) CALDEK V. DUFF. Mr. Gordon Allan, who appeared for plaintiff, asked for leave to appeal to the Privy Council in this case. The case was originally removed, under the Court of Appeal Act, from the Supreme Court without any decision, and the objection taken was that under the ordinances of the Privy Council the Court could only grant leave to appeal in cases where there had been a decision by the Court. When the case was removed from the Court below there was an assent that neither party should oppose any application to appeal. Mr. Bell, who appeared for defendant, did not oppose the application if the Court had power to graut it. The Court refused the appeal. SPENCE V. PEARSON. This was a similar case to the last one, Mr. Barton appearing in support of the appeal, and Mr. Bell opposing it. The Court refused the application to appeal.
