STREET ENCROACHMENTS.
TO THE EDITOR OF THE NEW ZEALAND TIMES, Sib,—lt is to be hoped that the motion of •which Councillor J. A. Allan has given notice—viz., “ The City Council having inadvertently exceeded its powers by granting to private individuals a tacit right to enclose and occupy a public street in the borough, do hereby rescind such resolution, and notify the same to the parties interested residingin Oriental-terrace” — will meet with the approval of the Council, and be at once carried into effect. It would be well also when the motion comes before the Council if some member would bo good enough to ask how the “ parties interested ” managed to acquire, or the Council to grant, such a right, the encroachment upon the public street being, I imagine, as improper as it is illegal in la reference to public interest. Inquiry might be made also as to tho citizens being completely excluded from the use of the northern end of Hawker-street abutting on Oriental-terrace, owing to a private individual having taken possession of it, erected fences across it, and turned into a garden. Of course the occupier will not permit the public to injure Ids garden by the exercise of their rights. Also as to another street in tho same locality (one of tho approach streets to the recreation ground or Town Belt, and within the limits of
the borough),havingbeen,aslunderstand, made a nice private pleasure-ground of, which the owner I hoar kindly lets to schools and pic-nic parties at so much per diem ; of course trespassing on that street by tho citizens being a matter not to be thought of.—l am, &c., Justice, Oriental Bay, December 7.
