COURT OF APPEAL.
Wednesday, November 21. (Before their Honors the Chief Justice, Mr. Justice Johnston, Mr. Justice Richmond, and Mr. Justice Williams.) CALDER V. DUFF. lii this case Mr. Cook and Mr. Stout appeared for the appellant, and Mr. Maoassy and Mr. Bell for the respondent. The action was originally commenced in the Supreme Court of Otago in 1872 against Charles Murray Duff, the defendant’s testator, for specific relief; and issues of fact which arose upon the pleadings were tried before Mr. Justice Williams and a special jury at Dunedin in January last, and a rule was obtained, which was subsequently made absolute for a new trial, and leave was given to the plaintiff to appeal to this Court. The plaintiff in tiie action was a contractor in Otago, and the defendant a doctor of medicine residing at Madras. The arguments were not concluded when the Court rose, and the case will be resumed at the next sitting.
The Court adjourned at 5 o’clock p.m. until next morning at the usual hour.
