Thursday, l\ oyember 8. (Before their Honors the Chief Justice and Mr. Justice Richmond.) PETERS V. JOSEPH.
This case, which was an action for damages for alleged trespass and unlawful conversion of goods, was tried at the recent civil sittings of the Supreme Court, when the plaintiff obtained a verdict for £SOO damages. It was now Bought to set aside the verdict of the jury, and enter it the .other way, in pursuance of leave reserved at the trial; or for a new trial on the ground of misdirection, that the verdict was against the weight of evidence, and also against the direction of the Judge who heard it, and also that the damages were excessive. Mr. Travers appeared in support of the rule nisi granted, and Mr. Barton to show cause against it. The Court reserved judgment. The Court then adjourned until Saturday.
