A fete in aid of the Indian Bund, postponed from Wednesday last, came off te-day. There was a good attendance. The jury in Proudfoot's case, after an hour’s deliberation, came into Court, and the foreman said he was requested to ask his Honor to again define what constituted an attempt to commit rape. He also said two or three jurymen were under the impression they could not bring in a verdict of seduction. The Judge said that a verdict of seduction would be an acquittal, and told the jury that he before had pointed out to them the difficulties in the way of returning a verdict of attempted rape. The foreman said there was no probability of their agreeing. The jury were looked up during the night, and at 10 o’clock this morning informed the Court that there was no probability of their agreeing. His Honor then discharged them, and said the course he proposed at present to take was to release the prisoner on the usual bail, to appear at the January sittings of the Supreme Court. It would be for the Crown in the meantime to consider T what steps should be taken in the matter. Mr. Deuniston said he had no application to make. The matter will now be referred to the Government to decide what shall be done. The survey of the Strath Taieri line will be commenced next week, and the survey party leaves town on Mouday. There was a heavy north-west gale yesterday, which has done considerable damage in the country districts. The following incident occurred At Malvern, as the West Coast coach was approaching Redfern’s Hotel, it was met by an extraordinary squall from the ranges, which the horses could not face, and as it became evident the coach must be upset, the driver and passengers jumped out. Mr. Crombie Brown, who was on the box seat, had a very narrow escape, but only sustained dislocation of the ankle. The moment the coach was relieved of the weight of the passengers it was lifted bodily into the air and dashed to pieces. The passengers had for some moments to lie on the ground to prevent being blown away, and with difficulty reached the hotel, which was only two hundred yards distant. There is an unusually high fresh in the River Opawa, The bridge on the main road was washed away. Communication with the railway station and the railway is cut off. This is the heaviest fresh since 1868.
