Charles Peyton, William Palmer, and Dan McDonald, were dealt with in the usual w?"4JF Charles Upton, against whom there we. 12 previous convictions, was fined 20s. or 4S hours' imprisonment. His Worship remarked that if accused appeared again on the rime charge he must send him to prison for a month. "the late fatal accident. John William Biddle was charged with driving over a little girl, Alice Russell, on the 26th June. Mr. Travers appeared for the father of the child ; Mr. Allan defended. Mr. Travers applied for a remand for a week. He was not prepared to proceed with the case, as he had only been instructed on Saturday last. As there was some fresh evidence, he thought the case had better be remanded. Mr. Allan opposed the granting of the remand. He submitted that the proper course to pursue was to discharge the accused. The police had raked xvp all the evidence that could be obtained. Any fresh evidence would only be confirmatory of that already given. His Worship thought it would be a great hardship to keep such a charge hanging over the man's head for a whole quarter, as would be the case if he were remanded for a week and then committed. After some further remarks, Mr. Travers left the court, saying he was unable to proceed with the case. Sergeant Monaghan informed the Court that the charge had been laid by Mr. Russell, and that after the action of the counsel for the prosecution, the police refused to proceed with the case. The charge against Biddle was then dismissed. CIVIL CASES. His Worship gave judgment for amount claimed, with costs, in the following cases : H. F. Logan v. R. H. Harley, claim £7 155.; J. Litchfield v. E. Folly, £2 ; National Bank v. Barker, £3O 3s. 10d.; andH. P. Logan v. P. Connell, £6 lis. 6d. E. W. Mills v. W. R Mason.—Claim, £9 19s. 6d. The defendant paid £7 7s. lid. into court, and disputed the balance. His Worship gave judgment for the amount paid into court j plaintiff to pay costs.
