(Before their Honors the Chief Justice, Mr, Justice Johnston, aud Mr. Justice Gillies.) IN THE MATTER OP HENRY SMYTHIES. This was an application by Mr. Henry Smythies, who had been struck off the rolls, for permission to practise as a barrister. . The case was not gone into, inasmuch as the rules prescribe that such cases must be heard before three Judges, and as his Honor Mr. Justice Gillies was of opinion that he ought not to take part in the case, and was about to leave Wellington to attend the Circuit Court at Taranaki, and Mr. Justice Williams was unavoidably absent, it was impossible to hear Mr. Smythies in support of his application. The Chief Justice intimated that a full bench of Judges would probably sit shortly at Christchurch, when the application could be renewed. The Court then adjourned
