RESIDENT MAGISTRATE’S COURT.
Saturday, January 30. (Before J. C. Crawford, Esq., E.M.) ASSAULT, Daniel Driscoll, charged with fighting 111 the streets, and assaulting Sergeant Price while in the execution of his duty, was fined .to, and sent to gaol for a month. VAGRANCY John Saunders, charged with vagrancy, was dismissed with a caution, there not being sufficient evidence to support the charge. FAMILY JARS. Bichard Barry was charged with assaulting his wife Mary Barry. The conjugal felicity of this happy pair has been a subject of frequent discussion before his Worship, who once more was called upon to listen to a few incidents in the life of Barry el uxor. Mrs. Barry prepared the way by declaring her husband to be a worthless, lazy, drunken scoundrel, who was in the habit of beating her and her son, and kicking them out of the house at unseasonable hours at night. This statement was followed up by a recital of all the troubles of the Barry family, to which his Worship lent a patient ear. The husband in his turn was equally edifying, but the police clenched the pair of them by informing the Court that Barry was • a dissolute lazy vagabond, and the wife a thorough-paced harlot, who shared the proceeds of her immorality with her husband, because he beat her if she did not. Of course both indignantly repelled such a slander upon their character, but his Worship .said he had seen enough of the two to lead him to believe that the story was unfortunately true. However, his only course in the present case was to bind the prisoner over to keep the peace for three months, and to order him to find two sureties ifi the sum of £2O, as a guarantee for his better conduct in future. The sureties were not forthcoming, and the prisoner was removed. LARCENY. D. Crosby was charged with stealing a kit, he property of Eliza Downey. Prosecutrix ' stated that she arrived on Friday by the Wellington from Picton, and entrusted her kit to the care of prisoner, who promised to take it to a place of safety. He took it to a shop, hut afterwards, when requested to bring the kit back, said it was not to be found. The accused adduced evidence to show that she went with him to another house, and left the kit there, whereupon his Worship at once dismissed the charge, and reprimanded Mrs. Downey for placing Crosby in such a position of disgrace without any good ground for doing so. The Court then adjourned.
