Government Notices JOHNSONVILLE LOCAL BOARD DISTRICT. PROCLAMATION. By His Honor William Fitzherbert, Esq., C.MGr., Superintendent of tlie Province of Wellington, in the Colony’ of New Zealand. WHEREAS by an Act of the Provincial Council of the said Province of Wellington, Session XXIY., No. 5, intituled “The Local Boards Act, 1873,” it is enacted that it shall be lawful for the inhabitants of any locality in the Province of Wellington,'exclusive of the inhabitants of the towns of Wellington, and Wanganui, to apply by petition to the Superintendent of the Province, praying that in such locality a Board of Commissioners may be appointed with the several powers and authorities given by the said Act, and that on receipt of any such petition, the Superintendent of the said Province may issue a proclamation declaring that the provisions of the said Act shall come into force within such locality, and that such locality shall thereafter be termed a district, and whereas a petition has been received by ,'ne from the inhabitants of tlie village of Johnsonvillc, in the Porirna District, signed by the required number of inhabitants, praying that the laud contained within the boundaries described in the Schedule hereto may be constituted a district under the said Act. Now, therefore I, William Fitzherbert, Superintendent of the said Province of Wellington, do hereby proclaim and declare that the block of land described in the schedule hereto, shall be, and the same is hereby constituted a district under the said Act, and that the said district shall be called, and known as “ The Jolmsonville District,” and that the provisions of the said Act shall come into force within the said “ Jolmsonville District” from and after this date. Given under my hand, and issued under the public seal of the Province of ■ Wellington, at Wellington, this (1.5.) tenth day of September, one thousand eight hundred and seventyfour. Estimated to contain about 1250 acres, more or less ; bounded towards the North by the new Ohariu line of road from Section No. 13, Porirua District, to Section No. 17, Ohariu District, by Section No. 13, Porirna District, and across a public road, and by part of Section, No. 14, Porirna District, sold to James Petherick ; towards the East by Sections Nos. 13 and 14, Porirna District, and by Section No. 1, Horoldwi Road District; towards the SouthEast by Sections Nos. 12 and 13, Harbor District, by the old Porirna Road and by Sections Nos. 2,3, 4, and 5, Porirua District:; towards the South by Section No. 9, Porirua District; -towards the South-West by Section No. 5, Porirua District, by the south-western boundary of Section No. 95, Ohariu District, and the production of the said boundary to Section No. 2, Porirua District, and by the old Ohariu line of road ; and towards the West by a straight line from the south to the north comer of Section No. 94, Ohariu District, and across the old Ohariu Road, by a straight line from the south-east corner of Section No. 91, Ohariu District, where the boundary line of Nos. 91 and 92 sections strikes the '■ old Ohariu Road to the south comer of Section No. 14, Ohariu District, and by Sections Nos. 14, 15, and 17, Ohariu District. WANGANUI AND WAITOTARA HIGHWAY BOARD. CONSTRUCTION ORDER, No. 7. THE Board having examined the deposited plan, section, and specification for the proposed Oruakainga Road, and considered the objections and suggestions made respecting such road, hereby order it to he constructed according to the line shown -by such plan, section, and specification. W. F. RUSSELL, Chairman. Wanganui, July 6, 1574. I hereby confirm this Construction Order, this 24th day of August, 1874. WILLIAM FITZHERBERT, Superintendent. WANGAEHU HIGHWAY DISTRICT. BYE LAW No. 1. TTNDER the authority of the provisions of YJ the 18th danse of “ The Highway Boards Empowering Act, 1871.” 1. It shall be lawful for the Secretary or any other officer of the Wangaehu Highway Board, authorised in writing by-the Chairman of the said Board in that behalf, to detain any person or persons in charge of or driving any cart, wain, or waggon, on or over any of the public roads or thoroughfares within the Wangaehu Highway District which, in the opinion of the Secretary, or other officer so authorised as aforesaid, shall he carrying weights in contravention of the provisions of the danse proclaimed to be in force under the authority of the 84th clause of The Highways Act, 1874, by a certain proclamation issued by his Honor j the Superintendent of Wellington, dated the 10th day of August, 1874; and to require such I. person or persons to drive or permit to be driven, any such cart, wain, or waggon to the nearest ; weighbridge, whether in the Wangaehu Highway District or in the .Towd of Wanganui or to such other convenient place where means may have been provided for the purpose of having the weight of the load upon every f such cart, wain, or waggon ascerccrtained ; and any person or person refusing so to do or wilfully obstructing the Secrej tary or other officer so authorised as aforesaid, shall be liable to any penalty not exceeding the sum of twenty pounds, to be recovered in a summary way before one or more Justices cf i the Peace ; and on the hearing of any such | complaint the Secretary or other officer may I recover all or any of the penalties prescribed by the said clause so proclaimed to he in force as aforesaid ; and no person or persons offending as aforesaid shall be entitled to plead or maintain on any such hearing that no proof was given that such cart, wain, or waggon in his or their charge was actually carrying a weight in contravention of the provisions of the danse so proclaimed to be in force as aforesaid, but it shall be incumbent upon such person or persons offending as aforesaid to prove that no breach of the provisions of the clause so proclaimed to be in force was committed ; and the Secretary or other officer so authorised as aforesaid shall for the purposes of this bye-law be deemed ’to have been properly constituted the agent of the Board upon proof at the hearing of any complaint as aforesaid that he was authorised in writing so to act by the Chairman of the Board : Provided that if under the powers aforesaid the weight upon any such cart, wain, or waggon should be ascertained as not exceeding the limit of the weight prescribed under the provisions of the said clause so proclaimed to be in force as aforesaid, such secretary or other officer acting under the powers conferred by this bye-law shall not bo liable for any loss or damage which may accrue from any necessary delay in ascertaining such weight as aforesaid.
