EXECUTIVE. Session I. No. 1. An Ordinance to Establish an Executive Government for of the Province of Wellington.
Preamble. Be it enacted, by tbe Superintendent of the Province of Wellington, with lh<r adv»ce Mid consent of tbe Provincial Conncil thereof, as follows i Superintendent's Duties. 1. The entire administration of tbe Provincial Executive Government shall be vested in tbe Superintendent alone, acting by and with tbe consent of an Executive Coonci), to be appointed as is hereinafter provided. 2. He shall keep and use officially tne public seal of tbe Province, 3. The present Superintendent shall provide a public seal for the Province, with aucb device and inscription as be may think fit, afnd the same shall not be subject to change except by an Act of the Provincial Legislature — until sucb seal shall be 1 procured he may adopt and ase sucb temporary seal as be may deem fit. Secretary, 4. There shall be a Secretary for the Prcvfntfev who shall kesp a record of, and attesfall official acts and proceedings of the Superintendent, Solicitor. 5. There shall be a Solicitor for the Province, who shall be the Legal Adviser of the Superintendent. i Treasurer, his duties, B>c. 6. There shall be a Treasurer for the Province, who shall receive and pay all monies payable for the uses and on behalf of the Province. 7. No public money shall be paid by the Treasurer unless tbe warrant for the payment thereof shall have been signed by the Superintendent aud registered in the Secretary's Office. 8. The Treasurer shall, before entering on the duties ot his office, give bond with a sufficient penalty, or other security, for the faithful discharge of hid trust to, and to tbe satisfaction of the Superintendent. 9. The Treasurer shall not, during his continuance in office, engage in any business of trade or commerce, nor act as a broker, nor agent, or factor lor any merchant or trader. Secretary may be Treasurer. 10. The office of Treasurer may be held by tbe Secretary of the Province until the Superintendent shall see fit to order otherwise. Executive Council. 11. There shall be an Executive Council of the Province. 12. The Secretary, Solicitor, and Treasurer of the Province, shall be members of such Executive Council. 13. The Superintendent may also appoint any other person or persons, not exceeding two, to be members of such Executive Council. Appointment of Secretary, S,c. 14. The Secretary, Solicitor, Treasurer and other members of the Executi v e Council shall be appointed by, and hold office during the pleasure of the Superintendent. To become vacant when. 15. The offices of Secretary, Solicitor, and Treasurer for the Province, shall, upon the election or re-election of every Superintendent ipso facto become vacant. Superinten lent may create other offices. 16. The Superintendent shall, from time to time, by and with the consent of the Executive Council aforesaid, constitute all j>uch other offices as he shall deem expedient for carrying on tbe business and affairs of the Province, and fill up the same, and also existing offices, whenever a vacancy shall occur therein, with fit and proper persons. He shall also have full power to suspend and remove any officer from his employment for neglect of, or inattention to, his duty, or for other just or sufficient cause. And prescribe Rules, #c. 17. The Superintendent shall prescribe rules for transacting the business or tbe several offices of tbe Province, and from time to time alter tbe same as to him may seem meet. Officers discharged or superseded may appeal. IS. If any person (other than tbe Secretary, Solicitor, and Treasurer of the Province, or other member of tbe Executive Council), shall deem himself aggrieved by his suspension or removal from office, he may ptesent a petition to the Executive Council shewing that he has been suspended or removed from office without just or sufficient cause, and praying for an investigation into tbe ground or charge on v/hich he may have been suspended or removed. Commencement of Ordinance. 19. This Ordindice shall come into operation from and after the day of the passing thereof, and shall be open to amendment during tbe present session.
