ABSTRACTS OF THE NEW ZEALAND BILLS OF THE SESSION, 1851.
[From the New Zealand Journal, Aug. 9, 1851.] 111. CANTERBURY ASSOCIATION BILL. Ihe preamble recites the purport of the Act 13 and 14 Viet., of the letters patent, 13 Viet., incorporating the Canterbury Association, and of the agreement between the Association and the New Zealand Company ; and declares that “ it is expedient to alter and amend some of the provisions of the said recited Act, and to prescribe for the better and more effective regulation of the proceedings of the said Association, and to confer additional power on the Association with respect to the land in the said settlement.” § 1. Enacts that the Association may impose penalties lor breach of bye-laws. § 2. Enacts that bye-laws shall be exhibited in some conspicuous part of the premises of the Association, “to give public notice thereof to the parties interested therein or affected thereby.” § 3. The bye-laws are to be so framed that the penalties may be mitigated by two justices before whom they are sought to be recovered.
§ Penalties imposed by bye-laws may be recovered before two justices, according to the Companies Clauses Consolidation Act. § 5. Production of a written or printed copy of the bye-laws of the Association with their common seal to be sufficient evidences of them. § 6. The proceedings of the committee of management of the Association are to be entered in books, and to be signed by the chairman, and are to be admitted as evidence. § 7. The Association may, under the common seal, appoint persons to act as a mawmg committee in the settlement of Canterbury, and delegate authority to them. § 8. The Association may reserve and apP ro P r iate land for public purposes, with this limitation: —“ Provided always, that for every acre of land so reserved and appropriated as aforesaid, that part of the funds of the said A »- sociation which, under the letters patem is or shall be applicable to the purposes for which such land is declared to be reserved and appropriated, shall be charged with and subject to the payment of a sum of money equal to the current price of every such acre considered as sold to an ordinary purchaser, and the said money shall be distributed and appropriated in the same manner as money arising from ordinary sales of land by the srnd Association ; provided also that it shall not be lawful for the said Association to reserve and appropriate land as aforesaid, unhand r P T\° f lhe said funJs the hands of the said Association for the time being, applicable as aforesaid, is sufficient to pay a sum equal to the price of such land considered as sold to an ordinary purchaser, after deducting the amount which would be appropriated to such part of the said funds in such distribution as aforesaid.” .iX%oZT' s ,he Associ>,i ’"•» § 10.
