SHERIFF'S SALE.
In the Supreme Court of New Zealand,
Between Edwin Abbott and Edwin Morton Abbott, Plaintiffs, and James Smith and John Howard Wallace, Defendants. BY VIRTUE of a Writ of Execution issued^ out of the Supreme Court of New Zealand against the Goods and Chattels of the above-named Defendants, the Sheriff will cause to be sold by Public Auction, on WEDNESDAY, the 27th day of March instant, (unless the said Execution be previously stayed,) at Eleven o'clock precisely, on the premises, situate on Wellington Terrace — in the occupation of one of the above-named Defendants — the whole of the Goods and Chattels therein contained, together with the interest of the said Defendant of and in the unexpired term of years of the said premises on Wellington Terrace, aforesaid: And at Two o'clock of the same day, on the premises situate in Boulcott-street — in the occupation of the other of tbe above-named Defendants — the whole of tbe Goods and Chattels therein contained : And at Four o'clock of the same day, on the premises situate en Lambton Quay — in the occupation of the said Defendants — all and sundry the Goods and Chattels therein contained, the property of the said Defendants. NOTICE IS HEREBY GIVEN, that James " Smith and John Howard Wallace, of Wellington, in the colony of New Zealand, trading together as Merchants and Auctioneers in co-partnership, under the firm of " James Smith & C 0.," did, by a certain deed (duly registered in the office of the Registrar of Deeds at Wellington, on Tuesday, the twelfth day of March, instant) bearing date theele\enth day of March, in lheyearof -.ur Lord one Thousand Eight hundred and Fifty, convey and assure unto William Filzhetbert and William Barnard Rhodes, both of Wellington, aforesaid, Merchants, and their heirs "All that piece or parcel of land, situate, and being upon Lambton Quay, in the Town of Wellington, being part and parcel of the section marked and numbered as number 510 upon the plan of the Surveyor General of the New Zealand Company of the said Town of Wellington, containing in front next Lambton Quay, -aforesaid, one hundred and thirty two feet or thereabouts, and in depth to the cliff or back thereof ninety feet or thereabouts, being bounded on the north by premises late in the occupation of Joseph Boulcott, deceased, on the east by Lambton Quay, aforesaid, on the south by ptemises in the occupation of one — Jackson, and on the west by the hill or cliff in the rear thereof before mentioned, together with the stores, erections and buildings now standing and being thereon, with the appurtenances. And, also, all that piece or parcel of land,' being part and parcel of the section number 10 upfbn the plan of the Surveyor General of tho said New Zealand Company of the district ot Kinapora, containing seventy-seven acres or thereabouts, bounded on the north by section numbered 12, on the east by section numbered 1 in the Horokiwi district, on the south-east by section numbered 12 and 13, in the Harbour district, on the south by a Native Reserve, number 9, and on the west by a portion of the same section formerly belonging to Charles lladford, and now to — Hammond, with the appurtenances thereto belonging." Subject nevertheless a&in thesaiddeed is mentioned. And by the same deed the said James Smith and John Howard Wallace did furthermore grant, bargain, sell, assign, transfer and set over unto the said William Fitzherbert, and William Barnard Rhodes " all nnd singular the debts, sums of money, household and other goods, chattels, wares, merchandizes, stock in trade, and other the personal estate and effects whatsoever of them the said James Smith and John Howard Wallace, or either of them, now remaining, and being in or about the dwelling houses, shops and stores of the said James Smith and John Howard Wallace, or either of them, situated in Wellington, aforesaid, or at or in any other place or places whatsoever, or in the hands or custody of any person or persons whomsoever, and which are set forth in the schedules under the said deed written." Upon Trust to sell or otherwise dispose of the said lands, hereditaments, and premises. And also all and singular the said goods, chattels, and effects, and to apply the money to arise from such sale or sales for the general benefit of the Creditors of the said James Smith and John Howard Wallace in equal proportions j amongst the several Creditors of the said James Smith and John Howard Wallace, according and in proportion to the amount of their several and respective debts, in the manner and .according to the provisions in the said Deed mentioned.
