Richard Whitens, alias Whitehouse, wa's charged by William Martin, a private of Police, with having stolen from the Portrof Auckland a certain schooner boat knownNfe the Comfort, the property of one Andrew Rooney. " M ' Archibald Watson Shand, acting landing waiter of the Customs, proved that the prisoner arrived in the harbour of Port Nicholson on the 13th instant, in charge of a small schooner which he represented to.be the Hope, and that the prisoner was unable to produce the necessary papers ( rec[uired b'y,Ythe, Customs^ i -""" '■"_ IT ' '' V O Andrew Arthur,M Turanga, Poverty Bay, proved the arrival of the prisoner at Poverty Bay, sometime in the beginning of' February last, in chaige of the vessel in question, that the prisoner represented the vessel to be the Hope of Auckland, and that be had been directed by the owners to proceed up the coast in search of freight. ' The witness chartered the vessel to convey a cargo to Wellington. William Champion, master of the schooner Undine, swore distinctly that the schooner called Hope, in the harbour, ,was the same he had known in Auckland as the Comfort* James Stuart, seaman of the Undine, corroborated the testimony of the last witness. The prisoner was committed to take his trial at the next criminal sittings of the Su-» preme Court, to be holden at Wellington.
