FOOTPATH BILL.
An Ordinance to provide for the protection of Footpaths in the Colony of New Zealand. [Passed the 14th day of October, 1847.] Be it enacted, by the Lieutenant Governor of New Zealand, with the advice and consent of the Legislative Council thereof, as follows : 1. When and so soon as any Footpath already laid out, or which shall hereafter be laid out, in any street, road, or public place within the colony, shall be well and sufficient*
ly made and completed for the use and accommodation of foot-passengers, it shall be lawful Sot bis Excellency We Governor, to declare the same by a .notice ,to be published in tb<e Government Gazette, to be a public footpath, and from and after' such notification, the same shall be deemed and taken to be, a public footpath within the meaning of this Ordinance. 2. Every such notice shall set forth, as nearly as may be, the situation and extent of the footpath to be named therein. 3. If any person shall wilfully run, draw, or ilrive, any truck, wheelbarrow, cart or carriage whatsoever, or shall wilfully, ride, lead, or drive any horse, or any horned or neat cattle, on any such public footpath, as aforesaid, every person so offending shall upon conviction, forfeit and pay for every such offence, any sum not exceeding Twenty Shillings, to be recovered in a summary way. 4. If any person who shall be found running, drawing, or driving any truck, wheelbarrow, cart or carriage, or who shall be found riding, leading, or driving any horse, or any horned or neat cattle, upon any such footpath as aforesaid, shall continue so to do, after being warned to the contrary, by any constable or other person, every person so offending shall upon conviction, forfeit and pay for every such offence, the sum of Five Pounds, to be recovered in a summary way.
