MUNICIPAL COUNCIL.

Wednesday, May 10, 1843. COUNCIL MET. Present: —-Mr. Hunter, Chairman, Mr, Lyon, Mr. Wade, Mr. Fitzherbert, Mr. Jenkins, Mr. Guyton, Mr. Waitt. Minutes of former meeting read and confirmed.

Mr. Ross attended upon the Council, and stated that, agreeable to the instructions he had received, he had attended at the sittings of the Supreme Court to watch the proceedings regarding a motion for a rule Nisi to call upon the Mayor to shew cause why he should not forthwith proceed to the election of Twelve Aldermen to form the Corporation for. the present year, he having failed to do so in the month of December last year, as required by the Municipal Ordinance sth Vic., No. 6, Sec. 31—rwhen it appeared that in consequence of the Attorney for the plaintiff in this cause having grounded his application to the Court upon the provisions of the 11th Geo. 1, Cap. His honor was of opinion that he had thereby created a difficulty in his mind, as to the propriety of his granting the rule under the provisions of that statute, as it was clear that these were applicable out of England, and consequently declined granting the rule. Mr. Hunter proposed and Mr. Lyon seconded 1 “ That the Finance Committee be authorized to pay the half-yearly salary of the officers of the Corporation, due the Ist of April last.” Agreed to. Mr. Wade submitted a rough estimate of the valuation of the property within ’ the borough, with a view of fixing a rate upon'tlie same. Which having been read, it was moved by Mr. Lyon and seconded by Mr. Fitzherbert;— " That it is the opinion of the Council, after carefully investigating the matter, and which is confirmed by that of the Town Surveyor, that the value of the land (exclusive of any improvements upon the same) within the borough is at least equal to 110,000/. It is therefore resolved that the rate for the ensuing year be fixed at three halfpence per cent, on that valuation.” Adjourned till Saturday at 10 o’clock. NOTICES OF MOTION. Mr. Fitzherbert:—That the Town Clerk be directed to apply to his Excellency, to fix some definite site for the custom-house for this borough, in order that the Collector of Customs may define the limits within the said borough between which it shall be lawful to land goods.” Mr. Wade : —“ That the sum to be paid for enrolment in the new Burgess List be fixed at 2s. 6d.
