MUNICIPAL COUNCIL.

Thursday, December I, 1542. Council met. Present, Mr. Hunter, Mayor, in the Chair. Messrs. Molesworth, Scott, Lyon, Johnson, Guyton, Jenkins, Dorset, Fitzherbert, Waitt. Minutes of former- meeting read and confirmed. Dr. Dorset moved, that the standing order, No. 4, be dispensed with; and That it is the opinion of this Council, that, according to the provisions of the Municipal Ordinance, Vic. 5, No. 6, Sec. 31, that the election of 12 Aldermen for the ensuing year ought to take place on Monday next, the sth day of December. Seconded by Mr. Waitt. Mr. Lyon moved an amendment—That it is the opinion of this Council, that by the provisions of the Municipal Ordinance, Vic. 5, No. 6* the second election of Aldermen does not take place until the first Monday of December, 1543. Seconded by Mr. Fitzherbert. Ayes—Messrs. Hunter, Lyon, Fitzherbert, Guyton, Molesworth, Jenkins, Johnson, and, Waitt. Noes—Dr. Dorset, Mr. Scott. Ayes 8 Noes 2 Majority for the amendment 6 Mr. Park laid before the Council a plan of the line of road along Lambton Quay, shewing the various encroachments upon the same.

Mr. Lyou proposed—That until the arrival of the certified plan of the Borough from Auckland, the Town Surveyor be recommended not to make out or survey any of the disputed property on Lamhton Quay. Seconded by Dr. Dorset. Moved by Mr. Fitzherbert, and seconded by Mr. Waitt—That the Town Clerk be directed to write to Mr. Harvey, giving him notice that the ground marked out for his new house, by direction of Dr. Evans’ surveyor, extends beyond the line of road, as laid down on the map of the Town, as laid out by the Principal Surveyor to the New Zealand Company. The Committee adjourned till Thursday next.
