TO THE ELECTORS OF THE PROVINCE OF AUCKLAND. GENTLEMEN,— In consequence of the unusual course adopted by Mr. Brown, we have deemed it necessary to submit the following statement for your consideration. Notices having been issued on Saturday last by the Returning Officer, to lhe effect that on Tuesday, I2th July, he would declare the person who had been, by i,he majority of Votes of the whole Province, july elected to the office of Superintendent, Mr. Brown, the unsuccessful Candidate, immediately instituted proceedings in the Supreme Court for the purpose of obtaining a rule nisi for a Mandamus against Thomas Beckham, Esq., as Returning Officer for three Electoral Districts in this Province, to require him to return the Writ under which he was acting as such Officer, with an endorsement or declaration thereon that W. Brown, Esq. was elected. These proceedings were based upon two affidavits—one by Mr. Brown himself, the other by Mr. Schultz—and by an affirmation made by Mr. Makepeace, to the effect that no Poll had been demanded, except by Mr. Connell. Now in opposition to this statement we affirm that as soon as the Returning Officer had declared that the show of hands appeared to be in favour of Mr. Brown, Mr. Connell stepped forward and demanded a poll. Whereupon—according to arrangements previously made —we presented oursehes to the Returning Officer, as those who united with Mr Connell in making this demand, and when he, as our spokesman, again addressed the Returning officer saying “We demand a poll on behalf of Robert Henry Wynyard”— the Returning officer distinctly and deliberately counted from our number —one —two three —four— five —six : a fact, which, as Mr. Brown stfitod close to the Returning Officer at the lime, could hardly have escaped his observation. The Returning Officer having satisfied himself that the poll had been legally demanded turned round, and announced the fact to the assemblage. As the affidavit of Mr. Schultz, and the affirmation of Mr, Makepeace arc much the same in purport as that of Mr. Brown, we deem it unnecessary to refer to them more particularly than by remarking that notwithstanding Mr. Makepeace has affirmed that “he was close lo the Returning Officer during the whole of the proceedings,” it is a fact very well known, that he was not even on the hustings, but occupied a conspicuous position in the crowd below.
