Ellis v. Read.

The defendant moved for a postponement of the trial on the ground of the absence of a material witness. Mr. Whitaker, for the defendant, read an affi« davit in support of the motion, which went to show that every effort had been made to secure tho attendance of the witness, who resides at Ilawke's Bay. Mr. Morriman, for the plaintiff, objected to the postponement of the trial. Tho Chief Justice said that there was an omission in the affidavit ; the defendant's attorney did not state that the witness could be in attendance by the next sitting of the Court. Upon the amended affidavit the motion was granted.
