Auckland, June 29, 1849. I\ly dear Sir, — I have received your note proponing three questions, and requesting an answer to them. The First — " What is the duty of a Judge in a race, and does the mere fact of his declaring a horse, first debar that hoise's subsequent disqutlificatiou, in lln event of objections being laised at the time, and afterwards substantiated?" The Second—" Is not a stakeholder bound to obey tbe award of regularly appointed Referees ?" The Third— 4< How lohg have you been concerned in Racinp; matters ?' The Judge at a Race Coursa (who il usually sworn) is merely an official appointed by the Stewards to decide and declare the placet the horses running in any race maintain in passing the Winning Post. He is not compelled to place more than the first and second horse, and there and then his duty as a Judge fit a Race coune terminate*. The mere fact of tbe Judge declaring a hone to have come in first does not debar that horse's subsequent disqualification, in the event of objections having been duly raised and substantiated. I consider a stakeholder bound and safe in obeying the award of regularly appointed Referees. I have been concerned in, and intimately acquainted with, Racing matters for upwards of thirty years. I acted as Judge at the two late Race meetings, held near Auckland, when it will be in tha recollection of all parties that I was frequently obliged to declare what were the real duties imposed upon a Judge, in consequence of parties, either through ignorance or design, wishing to impoie duties upon him which never were or could have been contemplated.
