COURT MARTIAL.
EXTR\CTS FROM BRIGADE ORDERS. At a General Court Martial licit! Nt Auckland, New Zealand, on the 2'->d <lny of Apiil, 1849, and of which General Court Martial, L'eutennn* -Colonel Daniel Bolton, Royal Engineers, waa President; Lieutenant Owen Wynne Grny, Stuff Officer of New Zealand Enrolled Pensioner", appeared a prisoner og llie following charge, viz.:— " For scandalous and infamous cunduet, unbecoming the character of an officer and n nentlcn^an, in getting np and attempting to r.utiport, in an unjustifiable and improper manner, disgraceful charges against his senior officer, Captain Charles Henry Montresor Smith, Staff Officer «>f New Zealand Pensioners, which charges 60 got u >, and so attempted to be supported hy Lieutenant Owen Wynne Gray, were found by the Geneial Court Martini by which they were investigated, at Auckland, New Zealand, fi oni tho eighth day of February to the third cluy of Match. 1849, to be totally without foundation ; such i conduct on the part of Lieutenant Gray being subversive of all discipline and subordination in tbn Pensioner Corp% and calculated to bring dincredil on Her Majesty's service." To which chaige the prisoner pleaded Not Guilty.
FINDING. The Coutt having maturely weighed and considered the evidence in support of the charge against the prisoner, Lieutenant Owen Wynne Gray, Staff Officer of New Zealand IVnsioners, his defence and the erj.. dence adduced in support of it, are of opinion that he is guilty of the whole of the charge preferred agirut him, with the exception of the words " scandalous and iufamous," of which the Court da ucquit him.
SENTENCE. The Court having found the prisoner guilty, of the charge) preferred against him, with the exception of the words •• scandalous and infamous," and taking into consiiletation bis former good service and cha° racter— (certified copies attached and marked R *, l t 2, & 3,) — do now sentence him, the prisoner, Lieutenant Owen Wynne Gray, Staff Officer of New Zealand Pensioners, to be suspended from all rank and pay for one year, to be severely reprimanded in such manner a» the Major-General commanding the tioopi in New Zealand may be pleased to direct, and fmther to be vcmuved lrom and rendered incapable of again serving in the Pensioner Force in New Zealand. In promulgating the finding and sentence paised by a General Court Martial on Lieutenant Otren Wynne Giay, Staff Officer of New Zjaland Pensioners, as n severe reprimand forms part of that sentence. His Excellency the Mujor-General Commanding takes this opportunity of reprimanding him accoulingly ; and His Excellency trusts that the extreme leniency of. fie coi demnation passed upon Lieutenant Gray, may have a =alutaiy inflaeuce upon his future conduct. The sentence will be carried into effect from this date inclusive. His Excellency the Major-General Commanding h pleased to direct that the above order be read on three successive parades, at the head of every regiment and detachment serving in this command. BIUGADIC OIiDERS. AuckUnd, 23th April, 1849. His Exrellency the Major-General Commanding is plensed to ouler, with reference to that patt of 'the sentence of a General Court Martini on Lieutenant Owen Wynne Gray, published ia Brigado'Orders of the 26th instant, which is in opposition to the 121 st article of war, *viz.~- *• To be suspended from all rank and pny for one year,"— shall be hereby rescinded, and Hi* Excellency confirms only tho latter portions of the decision of the Court upon that officer, viz.:— *' To be severely reprimanded in such manner as the Major-General Commanding the Tioops in New Zcjhnd may be pleased to direc'i and further, to be removed from and rendered incapable of agiiu serving in the Pensioner Force in New Zealand,'' Which sentence will take effect from the date of ths original order.
