TM^BEREAS by deeds of mortgage, dated respectively the 23rd day of January, 1843, and 21st day of February in said year, and made between John Evans of Kororareka, Bay of Islands, Yeoman, of the one part, and Hugh M'Liver, of the same place, Architect, of the other part, the said John Evans did thereby convey and assure unto the said Hugh M'Liver, his heirs and assigns (subject nevertheless to the redemption of the same 1 ) All that piece or parcel of Land, having a frontage to Kororareka Beach, 38 feet 6 inches, by a depth of 30 feet : And also, all that piece of Land in the rear of the aforesaid, measuring 30 feet in front, by a depth of 35 feet (and which said two pieces form part of the land comprised in a Crown grant of section No. 5, situate in the town of Russell, parish of Russell, county of Bedford, and territory of New Zealand) : And whereas, default has been made in the principal monies in the aforesaid deeds mentioned and interest: And whereas, the said John Evans is reported to be dead, notice is hereby given to the said John Evans, if living, or to the heirs, executor*, or administrators of the said John Evans, that in pursuance of the terms of the aforesaid mortgages the aforesaid two pieces of Land will be sold in three months from the date hereof, unless redeemed.
