CONVICTION OF SMITH O'BRIEN.
Morning Herald Office, Monday Morning, Oct. 9. We gave in our first edition (by extraordinary express) the announcement of the verdict of guilty against Mr. Smith O'Brien. We havenince received our reporls of the day's proceedings, but have only time to give the following nummary of their close :— The Chief Ju&tice hating concluded hii charge, the Jury retired to their room ; ihortly afterwirds they returned ino Court and asked through their foreman, if they could contict or acquit upon separate counts, or found thtir verdict upon all the counts ? The Chief Justice informed them that they could find a verdict upon five of the counti, and acquit upon the sixth (fon>p,issing the death of the Queen), Which had been withdrawn. The jury again retired, and at half-past five o'clock returned into Court. The anxiety and suspense at this period was painful in the extreme. The prisoner itood at the dock with very great nrmneis. The Clerk of the Crown read the issue paper, which contained a verdict of Guilty, convicting Mr. W. S. OBrien upon five of the counts and acquitting him under the sixth. The verdict was accompanied by the following recommendation to mercy :—: — " We earnestly recommend the prisoner to the merciful consideration of the Government, the Jury being unanimously of opinion that for many reasons hit life should hi spared* '* For self and brother jurors, " Richard Mausergh." The Court was then adjourned to Monday morning.
