Common of Pasturage on Waste Lands of the Crown.
21 . Whenever the Governor shall by proclamation duly made, divide any county or settled portion of the Province into Hundreds, and declare the boundaries thereof ; the Commissioner of Crown Lands shall, on or before the Ist day of December in each year, compute the quantity of waste lands of the Crown, in such Hundred, which is not held under any lease or license, and shall also compute the quantity of cattle capable of being despastured on such waste lands of the Crown as aforesaid, and having regard to the numbsr of acres held under grant fioin the Crown, within the Hundred. The Commissioner shall declare by notice in the Government Gazette, the proportionate number of great cattle and small cattle, which may be despastured on the waste lands of the Crown within the Hundred, in respect of any given number of acres within the same held under grant from the Crown, by the occupiers of land held as aforesaid. 22. In computing the proportions of cattle to be despastured upon waste lands of the Crown,
within the Hundreds as aforesaid, six head of small cattle shall be deemed equal to one head of great cattle. 23. The notice published by the Commissioner in the Government Gazette as afoiesaid, shall regulate for the year commencing from the day named in such notice, the proportion of cattle Ito be despastured by the occupiers of land held under grant from the Crown within the Hundred. 24. No person but an actual occupant of land held under grant from the Crown, within the Hundred, shall be entitled to despasture cattle on such waste lands of the Crown within the Hundred as aforesaid. 25. No person shall be entitled lo common of pasture until he shall have deposited with the Commissioner of Crown Lands a declaration, of the number of acres held under grant from the Crown, occupied by him in every Hundred in which he claims such advantage, such return to be in the form of schedule C. hereunto annexed. 26. No purchaser or occupier of any waste lands of the Crown shall enjoy common of pasture within the Hundred, until the Ist of Januaiy, next ensuing, when a re-calculation shall have been made by the Commissioner. 27. Pensioners occupying land under permission of the Crown, shall have the same rights regaiding common of pasture, as persons o*enpying land held under grant fiom the Crown. 28.Nahves or Half- castes occupying land with the consent of the Crown, shall have the same rights regarding common of pasture, as persons occupying land held under grant from the Crown. 29. Nothing herein contained shall be taken to prevent the sale by the Crown at any time, of any portion of the waste lands of the Crown as aforesaid, nor to affect the enjoyment of any purchaser or occupier thereof, when purchased. 30. The words," Great Cattle," shall be construed to mean horned cattle, horses, mules, and asses, male and female, and their offspring, above six months of age; and the words " Small Cattle," shall be construed to mean sheep, goats, and swine, male and female, with their weaned offspring, provided that this definition shall not be taken to permit or suffer the feeding of swine on any waste lands of the. Ciown, over which common of pasture may b enjoyed, or where a right to despasture a pioportionate amount of cattle may be claimed, in virtue of recently purchased land, or of land held under grant from the Crown.
Timber Licenses. 31. Persons occupying Waste Lands of the Crown for the purpose of cutting timber will be required to pay a fee of Five Pounds yeaily to the Crown upon the issue of the license. 32. The Commissioner of Croun Lands will determine the extent of land to which such license shall give a right of occupancy. 33. Such extent of Crown Land uill be estimated by the means which the claimant has of removing the timber and of profitably using the land. 34. No fresh applicant for a license will le permitted injuriously to interfere v Uh a portion of forest upon -\\hich another person may have expen ded capital and labor. 35. In the event of an occupant of a portion of forest upon which he may have expended any considerable sum in the formation of roads or improvements to facilitate the removal of timber, wishing to resigni gn his license he will if in the consideration of the Commissioner he should be regarded as having established 1 a claim to this indulgence, be permitted to tiansfer his license and right of pre-occupancy to such person as he may select.
General. 36. All disputes between persons claiming runs, and all complaints having reference to runs and timber licenses shall be heard and decided by the Commissioner of Crown Lands. 37. Any licensed person against whom the Commissioner of Crown Lands shall give a decision upon the complaint of another licensed person in any matter relating to the depasturing of cattle or the cutting of timber upon the Crown Lands, will be required to pay a fee of five pounds.

WnisßK ark the Mails ? — Public anxiety was on the gui vive throughout Tuesday ; foi the (lag-staff indicated the advent of a sail, and Ly unanimous consent, the stranger was set down to be the Emma with the longed for English mails. Captain Nelson promised to wait another day, in order that answers might be returned direct to letters which folks began to fancy already within their grasp. Day, however, waned— the ball dangling bravely from the staff, but, when morning dawned— Nor ball, nor sail was there !— Nor have either been visible since, the craft having doubtless passed the poit. The nimble Emma has yet to come ; the City ok Poonaii has gone — and, thanks to the railway pace at which the Sydney PostMaster pei forms his duties, we are left to bide ins time and to lose our own.
Vocal Concert.— A second public rehearsal of the Vocal Class, so skilfully arranged, and so admirably trained, by Mr. Outiiwaitk, and whose debut in .Fc binary, elicited such general commendation, is promised at the Hall of the Mechanics' Institute, on Thursday evening next. The lull of fare is a very attractive one, embracing seveial of the most choice songs, trios, and chorusses ; and, if we may be permitted to anticipate the futuie fiom the performance of the past, we may safely count »pon a treat of superior degree. In a community where harmless public amusements are rare — at a period when music is so generally and so ardently cultivated, we imagine it would be a piece of supererogation were we to do more than to call attention to the programme, which will be found in our advei Using columns. A rational amusement is offered at a reasonable rate, and the answcis to the invitation will, we trust, be a Lumper house. Need we add that the proceeds are intended to be appropriated to the benefit of the Institute ?
