Tuesday, March?, 184 8. The Queen v. George Clarke. This day was fixed for hearing the arguments of Counsel in a suit of sciiefaceas, brought by the Attorney General to revoke a Crown Grant of 4000 acres of land made by Governor Fitzßoy to the defendant, on the 16th May, 1844. It appeared that the defendant had pmchased land from the natives in 1836, and sent in his claim for investigation in accordance with the Lands Claims' Ordinance. This investigation took place before Commissioners Godfrey and Richmond, who reported defendant entitled to a grant of 2560 acres, which report was confirmed by the officer administering} the Government and pul lished in the Government Gazette. Subsequently, under the provisions of the Land Claims' Amendment Ordinance, the defendant's claim was referred to the investigation of Commissioner Fitzgerald, who reported that defendant was entitled to a grant of 5,300 acres, less exceptions ; upon which report a crown grant for 4000 acres was issued to defendant by Governor Fitzroy. His Honor heard the arguments of Counsel, and deferred judgment until after communicating with Mr. Justice Chapman. Mr. Merriman appeared for the defendant.
