RESIDENT MAGISTRATE S COURT. Monday, 6th September.
Before the Resident Magistiate, Thomas Beckliatn, Esq. Robinson v Tinina, — la this case* the complainant, who is u senior on the Tamaki load, sought to recover the sum of .£l2, as compensation for certain timber cut on land which he claimed as his, from the defendant, a native chief, to whom the proceeds of the timber so cut, were alleged to have been paid. It appeared that the complainant had purchased a piece of giound from Tinina. A deed was made and executed, in which tbe boundaries were endeavoured to be defined, but so vaguely in some respects, that the witnesses railed, could not say that the land on which the timber had been cut, was comprehended within those boundaries. It further appeared that the complainant had not gone over the boundaries of the land when the deed was executed, and that the timbered piece had alvvajs been disputed by the natives, as never having been sold by them. However, that since the sale of the timber in question, Tinina had >aid something to the effect that Mr. Robinson might have that poition, but this was left very questionable. The Resident Magistrate held that the complainant had not made out a valid claim to the ownership of the timber, and therefore directed he should be non-suited. The case had already occupied two days, and costs been inclined in iiirvey* and interpreting^, without any very distinct result ; but as the complainant had none on what might be considered reasonable gtounds, those costs would be made as light as possible.
