SUPREME COURT. Auckland, Wednesday, Ist September, 1847.
Before his Honor, the Chief Justice. The Court opened at 10 o'clock, and the following gentlemen composed the Graud.Jury. — R C. Barstow, (forjmau)} J. C. Blackett, J. A. Buttery, H. Carletou, \V. Davis, F. Fisher, W. S. Grahaine, T. B. Hutton, W. Lewis, J. I. Montefiore, L. McLachlan, ]). Pollen, H. Weekes, R. Wood, & M. Whytlaw, Esqrs. True bills were found on three separate indictments, against William Hughes, Michael Maguire, and Charles Curson, formerly privates in H. M.'s 58th Regiment of Foot, for having committed a series of robberies at the houses of Charles Warm, Thomas Heury, and Johu Waddell, in the neigh bourhood of Auckland, on the morning of the 26th July last. The prisoners were arraigned upon ihe first charge, of having stolen from the house of Charles Waun, at Remuera, I watch, and 1 fowling piece, of the value of more than £5, to which charge they pleaded not guilty. The Attorney General conducted the prosecution, and called Charles Warm, from whose evidence it appeared that the prisoners armed with muskets, went to his house, at about half past 3 o'clock on the morning of the 26th July, and carried away therefrom the articles named in the indictment, together with other 9, and also several articles of wearing apparel, the property of Mr, James Dilworth, who resided in a room of the same house. Several of the articles which wercfound in possession of the prisoners when they were arrested, were produced!] ti court, and identified by Mr. Warm, ah&Mr. Dilworth. The prisoners raised no defence, and.the jury, without leaving the box, pronounced a verdict »1 Guilty. The same prisoners were then arraigned upon the second indictment, which charged them with having Btolenfrom the house of Mr. Thomas Henry, of Epsom, several articles of wearing apparel, also on the inuruing of the 26th July. Thomas Henry deposed that three men came to his house on that morning, armed, and saying that they were in search of deserters. Two of them entered, and one remained outside on guard , they pillaged the house, and carried away several articles of wearing apparel, which were found in their possession when captured, and being produced, were identified by witness. He also identified the prisoners Hughes and Maguire, but could not swear to the other, as he could not see the man who remained outside. The Jury returned a verdict of "Guilty " against Maguire and Hughes,— Cui son, "Not Guilty." The Attorney General withdrew the third charge, and the prisoners were remanded until the following morning. John Wakely was placed on his trial for an assault committed on Hannah Newpora, (a native woman,) on the 9th June last. The Jury after hearing the evidence, returned a verdict of "Not Guilty." In the case of Dennis MacCarthy against John Ryan, — bill not found. The court was then adjourned until the following morning.
Thursday, September 2nd. The prisoners Hughes, Maguire and Curson, were brought before the Court, and his Honor sentenced each of them, on Ihe first indictment, to Ten Years transportation. Cursou was then removed, aud Hughes and Maguire were sentenced on the second' indictment, to Seven Years transportation, to commence from the termination of servitude of the previous ten jears. The Court was then dissolved. During the sitting on Wednesday, the Registrar announced that as there were no cases for trial on the 7ih instant, the Jurymen who had been summoned lor that day, would not be requiied to attend.
