STREET WIDENING
PAYMENT OE BETTERMENT A decision of importance to property owners and local authorities was give;; by the Full Court yesterday, which delivered judgment in a case relating to the principle upon which betterment should be paid in connection with stree... widening. The Court was asked to determine whether the respondents should pay betterment. In answering the question, in the negative the judgment said thai in the Court's opinion, as the Act now stood, whether the whole street (whaic.ver ''street'' might actually mean) or pari ol a lenglli of ;i street was widened, the liahiJiiy to charge for betlei nieiit was precisely the same, i e.. the persons subject to the charge were those persons who were the owners of kind fronting upon or having any frontage on the other side of the street directly or immediately opposite to the lands taken for street widening purposes. There were on the Bench their Honours ihe Chief Justice (the Hon. M. Myers). Mr Justice Hcidmrni. Mr Justice Adams, Mr Justice Blair, and Mr Justice Smith. Mr J. Stanton (Auckland City Solicitor) appeared for the Auckland City Council (the claimant), and Mr IF. I l '. O'f.eary, of Wellington, for the respondents.
