Mr Smith moved that the rule be made absolute, and Mr Barton be called upon to show cause why he should not be struck off the rolls. Hia Honor granted the rule to be made absolute and ordered that within 21 days after service Mr Barton answer the affidavit and pay the money, and within thet time or as soon afterwards as counsel can be heard, show cause why he should not be struck off the rolls, and that he pay Eirkman's solicitor's costs occasioned by the rule nisi.
