BY-LAWS.
Part I. — Penalty. I. Any persou offending against any of the provisions of any of these By-laws shall be liable to a penalty not exceeding £5 for every such offence. Past II. — By-laws Amexded. 11. The By-laws made by the said Council by special order on the 13th day of March, 1878, and confirmed on the 12th day of April, 1878 (hereinafter referred, to as " the said By-laws ") are hereby altered as follows : — Regulation of Meetings, Sfe. 1. Section 33, omit " this By-law " and substitute "Part 11. of these By-laws." Streets. 2. Section 80, omit " this By-law " and substitute "Part 111. of these By-laws." 3. Section 96, before "notice" insert "fortyeight hours previous." 4. Section 104, after " owner," insert the words, "or person in charge/' Omit the words, " and without proper guidance," which are hereby repealed. 5. Section 106, omit the figures "10 " and " 8," and substitute " 5 " and " 9 " respectively. At the end of Section 106 add, " Provided that during the months of May, June, July, and August any such cattle may be driven between the hours of 3 and 4 p.m. along WakefieUl Quay, and Mary Ann Street, and thence along Britannia Heights in a westerly direction to the City Boundary, but such cattle shall in every case be immediately preceded by one of the persons driving the same, who shall warn passengers that such cattle are about to be so driven." 6. Section 108, omit the figure and words, "8 o'clock at night " and substitute, " 7 o'clock at night." 7. Section 109, omit sub-section (7), which is heredy repealed. At the end of sub-section (16) add "without having one of the wheels thereof chained or otherwise sufficiently prevented from revolving." Nuisances. 8. Section 1 12 is hereby repealed and the following substituted in lieu thereof: "No person shall use any vehicle for the conveyance of nightsoil in or upon any street ■within the City of Nelson, unless such vehicle shall be a proper covered cart of a construction approved of by the Inspector of Nuisances appointed by the said Council." Waterworks. 9. At the end of Section 119 add, "Provided that no such fee shall be charged for any license issued to any person then holding a Gasworks plumber's license for the then current year. 10. Section 122 is hereby repealed, and the following substituted in lieu thereof : " ' Ordinary supply ' shall be deemed to be such quantity of water as may reasonably be required for use upon lands or buildings to which water is or can be supplied for purposes other than such as are included in * extraordinary supply.' " 11. Section 123, sub-section (a), omit "six" and substitute "five." Sub-section (b), omit "two," and substitute " one." 12. Sub-section 135, omit all the][words after " follows " and substitute : " Meter with l^in. connection, ss. per month. » 2 „ 7s. 6d. „ Smaller meters at proportionate rates." 13. Section 129, insert "way" before "interfere." - Prevention of Fire. 14. Section 132 is hereby repealed and the following substituted in lieu thereof • ; "No person being the occupier or person in charge of any building in the City of Nelson shall negligently allow any chimney belonging thereto to become foul, and to be or to be in danger of being set on fire. 15. Section 133, omit the words "or the land of any adjoining owner," which are hereby repealed. 16. At the end of Section 138 add, "or in some magazine used by the General Government for the storage of gunpowder, Provided that nothing herein contained shall extend to prevent any person from keeping in any building within the City of Nelson any quantity of kerosene not exceeding 16 gallons or any quantity of gunpowder not exceeding 2 lbs. at any one time for private use. 17. At the end of Section 139 add "Provided that no greater quantity of gunpowder or other explosive material than shall be stated in any such license shall be placed or stored in any such building at one time." 18. At the end of Section 140 add " Any license to keep less than 160 gallons of kerosene or any gunpowder or other explosive material shall be deemed a retail license." 19. Section 141, omit "complying" and substitute " compliance*" 20. Section 142 is hereby repealed. Lighting. 21. After Section 147 add the following .- (a) " Licenses may be issued by the said Council to competent Plumbers to lay pipes and do any work in connection with the Gasworks, and no unlicensed person shall do any such work or in any way interfere therewith." (b) " A fee of five-shillingß shall be issued for every such license, or any renewal thereof." (c) "Any such license may be suspended or cancelled by the said Council, if it shall be made to appear to their satisfaction that the holder thereof has been guilty of any breach of any By-law of the said Council for the time being in force relating to Gasworks, or any instructions issued by the said Counci with reference thereto,"
Baths. 22. After Section 159 add the following : "No person shall bathe in the said * Marine Baths/ or in any river or stream within the said City of Nelson within view ot any street, without wearing bathing trunks or drawers." Carriages. 23. Section 161 is hereby repealed and the following substituted in lieu thereof: (a) "No person shall ply for hire with any vehicle for the carriage of passengers or goods within the City of Nelson, except in pursuance of a license so to do granted by the Council of the said City, nor ply for hire with auy vehicle for any other purpose than that for which it shall be licensed." (b) " The Town Clerk may by indorsement on any such license from time to time authorize the temporary use, for such period as shall be stated in such indorsement, of any vehicle to be specified therein in lieu of the one mentioned in such license." 24. Section 170, omit, "approaching" and substitute "meeting." 25. Section 171. In sub-section (6) omit " north " and substitute " south." At the end of Subsection (9) add " commencing at a point opposite the Corporation Lamp Post and extending towards the Government Wharf." 26. At the end of Section 181 add, " Double fares niay be charged between 6 and 8 o'clock a,m., and between 9 o'clock p.m., and midnight." 27. At the end of section 182 add, " Fares by time between 9 p.m., and midnight by special agreement." 28. Section 186, omit "that age " and Bubstitute " the age of two years." 29. Section 190, omit " driver or conductor " and substitute " licensed driver or conductor when practising his calling." At the end of Subsection (11) add, " Provided that such driver may leave his vehicle unattended (except when the same shall be upon a public stand) for a reasonable time for the purpose of taking in or delivering his passengers' luggage, but one of the wheels of such vehicle shall during such time be chained or otherwise sufficiently prevented from revolving." Boats and Boatmen. 30. Section 203, omit "or any vessel inside the haibor " and substitute " and any vessel inside the harbor." 31. Section 210. In Sub-section (1) omit the word " Omit " and substitute " Kefuse." Firearms. 32. Section 211, after " excuse " insert, " or' the permission of the Council." Part 111. — Porters. 111. No person shall work for hire as a Public Porter within the City of Nelson, except in pursuance of a License so to do granted by the Council of the said City, and Section 3 of the said By-laws shall be deemed to be incorporated herein. IV. A fee of ss. shall be paid for every such license. V. Every Licensed Porter whilst practising his calling shall wear such badge as the said Council shall from time to time appoint, and shall produce his license on demand to any person hiring or wishing to hire him. j VI. No Licensed Porter shall transfer his badge or license to any other person. VII. The following shall be the scale of Fares which a Licensed Porter may demand :— Table of Fares. Double Fares by distance or time may be charged between the hours of 9 p.m. and 7 a.m. YJH. No such Porter shall demand or charge any sum in excess of the above scale of fare's. < IX. Every such Porter shall work for any persjon wishing to hire him between the hours of 7 a.m. and 9 p.m. on every day except Sundays. | X. If any such Porter shall be guilty of any wilfjul breach of any By-law made 1 by the said Council, or lof any other misconduct, the said Council may suspend or revoke his license. ■ Part IV. — Hawkers and Pedlars. XI. No, person shall exercise or carry on the business of a Pedlar or Hawker, or act as such within t le City of Nelson, except in pursuance of a license grant id by the said Council, and Section^ of the said By-lai rs shall be deemed to be incorporated herein. XII. These By-laws shall not extend to prevent aiky person or persons from selling or offering for sale fisn, milk, or vegetables in any street or public place, pr selling or exposing for sale any goods or merchandise in any public market, or in any public place set apart by the Council for the purpose. ! XIII. The following fees shall be payable in respebt of eyery Pedlar's or Hawker's License or any renewkl thereof. ' License with Cart ... ... ... £5 0 0 „ without Cart... ... ... 1 0 o ' Part V. — Footways. XIV. The cost of constructing such footways us shall from time to time be laid out by the Council of the City of Nelson, and constructed by them of asphalt or concrete, shall be a charge upon the occupiers if lands and buildings fronting on such footways in tb e proportion following, that is to say : — One half of the actual cost of the construction of such footways in proportion to the length 4f the footway adjoining such lands or buildings. ! The foregoing By-laws were made by special order on the 19th day of November, 1878,-and confirmed on the 20th day of December, 1878, and the common seal of the Corporation of the said City has been hereto affixed in the presence of . .
