BRIGHT WATER COURT.
THIS DAY. [Before L. Broad, Esq , K.M., and G. Talbot, H. Martin, and G. W. Lightband, Esqs., J.J.P.J Lindsay v. Griffiths.— Action to recover 14s 9d under the Cattle Trespass Act, 1878, Mr P. B. Adams appeared for the plaintiff and Mr Pitt for the defendant. It appeared in argument that there was some dispute about the boundaries of the plaintiff's land as some of it was in the river bed and unfenced, also about jthe ownership of the cattle. The Bench decided that the plaintiff had proved his case, and [that it was unneceseary in an action for trespass^to bring corroborative evidence of the trespass, and gave judgment for the amount claimed and £1 Is costs Croucherv. Seatle.—CMnx for £3 10s for goods supplied. Judgment for amount claimed and costs. White v. Turner.— Action for £25 3s for work done by the plaintiff. Mr P. Adams appeared for defendant. Plaintiff said he was a carpenter, and had been working for defendant as such at the rate of 7s a day with board and lodging. There had been no agreement between the parties. Against
this claim defendant put ia a set off for £14 for board and lodging during the time plaintiff was working for him as a carpenter. The whole question turned upon what was a fair day'B wages for a carpenter with board and lodging, and the Bench decided that 7a was a fair wage, and gave judgment for amount claimed, less £4 10s which they considered plaintiff should pay for six weeks' board and lodging while he was not working for defendant. Sigqelkoio v. Sch r oder. — Action to recover | £10 ss, the value of a sheep dog and pup detained 03' the defendant. Mr Bunny appeared for the plaintiff, and Mr Pitt for the defendant. The point at issue was whether the dog was given or sold. The Bench thought it a pity the case had been brought into Court, as it was more one for arbitration! The weight of evidence was considered to be with the defendant that the dog was a gift, and the case was dismissed,
