lie Webley Brothers. Mr Pitt appeared for the Trustee of the assigned estate, and Mr Acton Adams for the mortgagee, Mr Watters. His Honor said the Trustee asked under Section 111 of the Act for the advice of the Court respecting certain buildings and other property claimed by the Mortgagee, bat which, it was contended by the Trustee, belonged to the creditors .It was evident from the affidavit of the Trustee, and the statements and documents of the mortgagee, that there was a bonctfide dispute as to the ownership of this property. It was equally clear that this Court could not settle the question. The advice therefore he would give the Trustee was that the question of ownership should be settled by an action. The Trustee would be allowed the costs of the application out of the estate.
