MAGISTRATES' COURT.

[Before C. Hunter Broavn and J. R. Dodson, Esqs., J. J.P.] Alfred Carter, for using abusive language in the street, was fined 10s, and costs 6s 6d. William Taylor was charged with using insulting behaviour to Anthony Hurst on the Port road. Mr Bunny appeared for the complainant, and Mr Percy Adams for the defendant. Mr Bunny stated that on Friday last Taylor met the defendant on the road aud placed his finger to his nose in an insulting and provoking manner. Some months ago there had been a court case between the two, and ever since then he had lost no opportunity of insulting him with a view to provoking a breach of the peace. Complainant, on being put in the box. said that when goius; to the Port he met Taylor, who behaved as though he was in liquor, and tried to get away from his friends towards complainant. They endeavored to stop him, but he got one hand free aud held it up to hii nose. A little further on he put both hands to his nose. On two or three previous occasions he had used insulting behaviour towards him. Cross-examined: He did not speak to me. He wxs about seven yards away from me. There were two or three men behind me at the time. For the defence W. Taylor denied ever having made the grimace complained of. Cross-examined : Did not remember ever having made tha grimace complained of. If he had pud his hand to his face, it was only to scratch his nose. Was perfectly sober at the time. George Thomason was with Taylor at the time. Did not hold him by the arm. Did not see him make any grimace at Hurst. What Hurst had said in evidence was not true. The Bench dismissed the case, each party to pay his own costs. Caun v. Napper. — Judgment summons for £8 Bs. Mr H. Adams appeared for the plaintiff. Defendant did not appear. Ordered to ba paid immediately with interest at 5 par cent, or, failing payment, defendant to ba imprisoned for two months.
