DISTRICT COURT.
[Before His Honor Judge Broad.] Thiel V. City Corporation. Mr Pitt moved for the adjournment of this cause. He aaid proceedings had been taken by the defendants to remove this action int-a the Supreme Cour,t; but owing tb. ifrformaiiiie* ih the proceedings the application #as refused. But hia agent iv Wellington had waived further objection, and allowed the counsel for the Corporation to move afersh for a writ of certiorari, and the Chief Justice had not yet delivered judgment. Mr. Acton Adams appeared for the Cor-pot-atiotl. His Honor said the rules of the Jjbistnct Court appeared to have been disregarded, as no copy of the rule or affidavita had been served upon that Court as required by the rules. There was really nothing in the shape of a proper stay of proceedings, but as plaintiff bad waived other formal objections, he supposed the proper course was to grant the adjournment, with costs, of course, against the Corporation. Mr Adama said of course lv's clients must pay the costs of adjournment. His Honor then allowed the case to stand adjourned to the 27th.
