[Before 0. Cvnvts, 3. Shephaud, and W. Olduam, Esqs., J.J.P.] W. Harley v. Price.— Action to recover £i for beer supplied. Plaintiff yesterday withdrew the case, but to-day Mr Acton Adams, for the defendant, apppeared and stated that his client had employed professional assistance, and subpcenaed.a witness from Wakefield, and he asked that costs might be allowed. The Bench, under the circumstances, grauted £1 lGs costs. Charles Y. Fell was charged by the Town Clerk with a breach of the City bye-laws iu neglecting, after the receipt of an order to do so, to clear the gorse on a town section of which he was the owner. Mr Acton Adams appeared for the complainant. This was a test case, and the defendant was fined ls without costs, against which he will appeal in the Supreme Court.
