RESIDENT MAGISTRATE'S COURT
[Before L. Broad, Esq., R.M.] Edwards and Kerr v. Wiesenhavern. This case occupied the Court the whole of ) Tosterday. The following are the"plantiffs' particulars of demand : — '■ Damages for the defendant by himself and his servants during the summers of 1875, 187G, and 1877 trespassing on lands in the Wairoa Gorge forming part of the plaintiffs' station, and driving therefrom sheep belonging to the plaiutiffy, and for wrongly shearing those sheep and other sheep which had strayed on to the defendant's property, and converting the said sheep and their lambs and the wool thereof to the defendant's use, £90. Damages for the defendant detaining and converting; to his own use a cow and calf of the plaintiffs' £10. Total, £100. Mr Acton Adams appeared for the plaintiffs and Mr Bunny for the defendant. The following letters, which were put iv as evidence, best explain the dispute between the parties : — To Mr A. Wiesen havers, Tophouse. Dear Sir — The present owners of Tarndale, Messrs Edwards and Kerr, instruct us to request payment for a bullock of theirs killed by you; for a, number of: sheep shorn by you; aud for a cow aud calf now detained by you, say Bullock ... ... ... XlO Wool ... ... .. £15 Cow and calf ... ... £7 10s Total £32 10s. They have proof of your sending your servant iuto the Gorge and musteriug stray Tarndale sheep and afterwards shearing them. Any reasonable compromise will be accepted, but unless you pay us fair compensation Edwards & Kerr will certainly sue for the full amount. The present owners, Messrs Adams and Kerr, have no desire to quarrel with you, but will iusist ou your not trespassing on their Raiubow country, whether after your sheep and cattle or not, and also on your giving them proper notice of your musters. They object to your getting in your sheep in small numbers instead of having a full muster and allowiug them to have a fair draft. Yojrs, &c, Adams & Keer. kelson, 17th January, 1878.
