DISTRICT COURT.
IN BANKRUPTCY. [Before His Honor Jodqb Bboad.] He William Thomson Mr Pitt moved for a declaration of complete executioa of the Deed of Assignment to W. H. Buckeridsre for the benefit of all the creditors. The Court made the order as prajed, notice to be gazetted in the Colonist newspaper. lie Thoa. ¥. Morley, a Bankrupt. Mr Pitt mored for the bankrupt's discharge and read the usual affidavits. Mr Bunny appeared to oppose. It appeared that at the meeting of creditors th«r« w*e present, only Mr Bunny as proxy for two creditors, and Mr Payne representing hiujgelf and Mr Flowerday. The Trustee was put in the chair, and on the motion of Mr Bunny, seconded by Mr Payne, it was carried unanimously that the bankrupt's discharge be suspended for twelve months. Against this resolution the bankrupt now appealed to the Court. The bankrupt, his father, and Thomas Payne were examined at some length, and, after counsel had addressed the Court, Hjs Qouor^ said that there was nothing disclosed to justify the suspension of the bankrupt's certificate. There was no conceslm«nt of assets, nor any fraud, the whole amouut of debts in Nelson was under £50, and, in view of all these facts, there was no particular recklessness in incurring them. Bankrupt would be discharged.
