[Before L. Buoad, Esq., It.M., and J Syiuons, Esq., J.P.] Willhiin Walker was fined 10s and costs or 48 hours imprisonment, for bein°- drunk ami incapable. William Wells charged with allowing three head of cattle to stray in the streets was fined os each and costs 9s. James Stock we 11 was charged with illtreating a horse in Ins possession. Sergeant Nash said his attention was called to the horse, and on examining it he found the animal's knees b;ul!y cut, and quite raw. A few days later he went to the stable and found them in the same condition nothing having been done to them. ' Jiobert Sunley : On the 20th insfc. I sawby the horse's uueasy movements that something was wrong with him, so I went up and examined it, and found two bad wounds on the knees. I called Sergeant hash's atteutiou to it. Thomas Men.iry stated that on Sunday last having been told about the horse he went up to the stable and found the wounds clean and carefully dressed, and the animal in good condition. Frederick House for the defence stated that he was in the cab when the horse fell It went down oa its knees and was up a <rain directly. ° Defendant said that the accident happened just before Sergeant Nasti spoke to him, aud he took the horse home immediately afterwards. The Bench considered that the animal was not iu a fit state to be driven, but on the whole the case was not one to call for a severe penalty, as there had been evidence to show that the wounds had beeu looked to afterwards. Pined 10s and costs £[ 9s. Farrelle v. Schwass. —Action to recover £7 for professional attendance from defendant, a sawyer at Clora Bay. The account had been owing for four yeara. Judgment for amount claimed to be paid at the rate of £1 per month, and costs £4 6s. Mr Acton Adams appeared for the plaintiff. W. V. Salter v. 11. Whiting.— Action to recover £4 5s 3d. A set off had been lodged for £3 for baths had by the plaintiff at The Hardy-street Baths when defendant was the lessee of them. Mr Pitt appeared for the plaintiff, and Mr Fell (for Mr Jiunny) for the defendant. A cheque which had passed through the Bank was produced showing that ! the £3 had been paid to Mrs Whiting Judgment for plaintiff for amount claimed and costs £1 ids.
