Saturday. * At the Auckland Police Court to-day Mr Tonks was charged on the information !of: the Collector of Customs with haying uncustomed goods on his premises! He pleaded guilty and was fined £25. Captain Moffatt, of the barque Santiago was charged with landing a harmonium on which no entry had been passed. He also pleaded guilty and was fined £25. Another charge was withdrawn. Dunedin, Saturday. ■ In deciding the demurrer by 'fc. plaintiff to defendant's pleas in the case of the Fever Hospital, Judge Williams said:—" What we neve to decide is whether the powers given by the Public Health Act to Local Boards of Health would enable them to divert land held by them in another capacity from the purpose to which it has been devoted,, to divert it, not temporarily, but permanently, I have no hesitation in holding that the Public Health Act gives no power of the kind. As to the remedy being by prohibition, the Local Board of Health being a judical body, I am of opinion that that is, not the case.-: The Local Board of Health is- an adminiitrative body, and if it was a judical .body, the act now complained of is an administrative act.
