A very interesting, aud at times amusing case was heard before the Resident Magistrate I this morning, when three petitions were before'the Court regarding the late election of a Councillor for the Ridiug of Motueka, one petition having been lodged by Mr White, the defeated, against the return of Mr Bird' the successful candidate, and two from -Mr Bird and his friends prayiug that on the ; grounds stated in our report of the case the whole election might be declared void. The complications arising from having to deal with two Acts as oue were numerous, and at ' times even the lawyers seemed' puzzled* and appeared to be a tittle doubtful of the ground ou which they were standing. A clever attempt by Mr Pitt to have Mr White* petition dealt with first with a view, in the event of its being upset, to withdrawing those of Mr Bird, in which grounds were shown for declaring the election void under any circumstances, was defeated, and the three petitions were treated together, the result beiflg that the election was declared void on the ground that sufficient notice had not been given by the Returning Officer, There are other elections in the same County, that might have' been upset for a. similar reason, had' petitions been lodged within the stipulated period of; fourteen days.
