It is proposeii^to expend the money to be borrowed in Ufc construction of a Wharf and Dry Dockytnd Reclaiming Land io. the Neleon Harbor, which works ffill form part of the eepdrity. The repay ment of all moneys advanced will be Becured by a Deed of Mortgage of the Laud mentioned in the schedule, executed and given according to the piovisiens of the "Loan Act, 1874." The Mortgage will be for a Term of Twenty Years from the date thereof. Such Deed win contain, amongst the other usual provisions in Mortgage Dteis stipulations to the following effect: — (1.) That in the event of the General Government of New Zealand or the Provincial Government 01 Nelson Requiring to take or use any portion of the land comprised in such se.urity for Railway purposes, th<.y shall be at liberty S^Jake and use the same therefore without the consent of the Mortgagee being nectasary tv be obtained, and without the Mortgagee thereof being entitled to any payn.ent or compensation in respect thereof. (2.) lhe Mortgagor shall not be bound to iusure any builoings or erections on the said security. (3.) 'lhe interest to be payable half-yearly at Nelson. (4.) The Superintendent to be at liberty irom time to time to grant any lease or Kases of the said land or any part thereof without the consent of the Mortgagee, an J suth leaseslo be as valid as if such mortgage had not been executed. The ordinary or other revenue of ths Province of JSelson will not te liabie to ba charged with, or be liable. for, the repayment of any moneys to be so advaated, nor will the Superintendent be persoifelly liable by reason of his signing any such'detd of Mortgage Portions of the land to be iaciude<i in the security are at present leased for various terms of years, the rentals now received Irom the lessees thereof amounting to £1050 per annum, and the rentals iccreasing for subsequent portions of the terms of the lease. The land will be mortgaged subject to such leases.
